To safeguard consumer rights and fulfill obligations under the EU Data Act, Govee has launched this page, which contains information related to the EU Data Act (Regulation (EU) 2023/2854 of the European Parliament and of the Council of December 13, 2023 on harmonised rules on fair access to and use of data and amending Regulation (EU) 2017/2394 and Directive (EU) 2020/1828) (Data Act).

  2. User Data Access, Deletion, and Portability

Under the EU Data Act, individuals or legal entities who use our connected products (hereinafter referred to as "Users") have the right to request access, deletion, or portability of data generated/collected by the connected products.

3. Data Sharing and Compliance with Data Requests

Pursuant to Articles 4 to 7 of the EU Data Act, data generated by our connected products may be shared with third parties, upon request from the following entities:

3.1 Business-to-Business (B2B) Access Requests

Based on the user's explicit consent.

The contract should stipulate: purpose limitation, confidentiality obligations, data security measures, and prohibition of misuse.

3.2 Business-to-Government (B2G) Access Requests

Pursuant to Articles 14 to 18 of the EU Data Act, data may be shared with public authorities: Article 15 permits such use in emergencies or for the performance of legitimate public tasks (e.g., natural disasters, public safety, epidemics).

Data is transmitted through secure encrypted channels, bound by strict purpose limitations.

Government entities must submit a formal written request with access to log records.

The principle of data minimization applies to all shared datasets.

4. Data Security and Protection Mechanisms

To ensure the security of data generated by Govee-manufactured connected products, we have implemented the following technical and organizational safeguards for data transmission, storage, and access:

Comprehensive encryption is employed during storage and transmission to prevent unauthorized access, use, or disclosure of data (e.g., using HTTPS encryption services).

We regularly review our data collection, storage, and processing practices (including cloud security measures) to prevent unauthorized access to or tampering with our systems and data.

An access control mechanism is established to grant data access only to authorized personnel on a need-to-know basis.

We conduct security and privacy protection training, testing, and other activities to enhance employee awareness and proficiency in data protection.

We use internationally and industry-recognized standards to protect your data and actively seek relevant security and privacy protection certifications.

5. Interoperability Description

We ensure that the data provided to recipients is in a structured, commonly used, and machine-readable format, complying with the interoperability requirements stipulated in Article 33 of the EU Data Act.

6. Restrictions on Use of Information and Prohibited Uses

Unless expressly authorized in writing by Govee or required by law, data may not be used for the following purposes:

- Developing competing products.

- Reverse engineering of algorithms.

- Targeted advertising or user profiling. Any violation of these restrictions may result in legal consequences and revocation of access rights.
